Provide a Brief Summary
I’m the owner of a self-storage facility. When a tenant stops paying and refuses to remove their items, Texas Property Code: Chapter 59 requires us to place two notices in the local newspaper prior to a foreclosure sale. The notice is intended to attract bidders to the lien sale which will reduce the tenant’s debt, not to notify the tenant. The requirement of sending notification by verified mail to the tenant will not change with this bill.
This bill will allow for alternative means of advertising the sale as the newspaper is no longer the best source for attracting bidders. House Bill 1093 does NOT eliminate newspaper advertising as an option. It just provides more modern alternatives. Selling items at a lien auction is not a profit center. Self-storage operators are fortunate to break even on covering what is owed, but we’re typically left in the red.
